Terms of use

These terms are the deal between you and 10Mil LLC when you play our games or use this website. We've kept them as plain as we can. By playing or using the site, you agree to them, so please read them, especially the parts on disclaimers, our liability and where disputes are heard.
The agreement
These terms, together with our privacy policy, are an agreement between you and 10Mil LLC ("10Mil", "we", "us"). They apply to our games for iPhone, any updates to them, and this website. If a game comes with extra rules, for example for a special event, we'll show them in the game, and they become part of these terms.
By downloading, opening or playing one of our games, or by using this website, you agree to these terms. If you don't agree, please don't use them.
You must be old enough to make a binding agreement where you live. If you're not, a parent or legal guardian must agree to these terms for you, and they're responsible for how you use our games.
Our games and this website
Our games are free to download and play, are paid for by ads, and are made for iPhone and the App Store. This website tells you about 10Mil and how to reach us. We work hard on both, but we can't promise they'll always be available, free of bugs, or work on every device.
Your progress is saved on your device, not by us. If you delete a game, reset your phone or lose it, your progress may be gone for good, and we can't restore it.
Your license to play
We let you download and use our games on Apple devices you own or control, for your own personal, non-commercial entertainment. This license is limited, non-exclusive, non-transferable and revocable, and it's subject to these terms and to the App Store terms below. Our games are licensed to you, not sold, and we keep every right we don't expressly give you.
App Store terms
Apple requires every app's terms to include the points below, so they stay close to Apple's wording. They apply when you get one of our games from Apple's App Store, and if anything else in these terms conflicts with them, these points win.
- Between you and us. These terms are concluded between you and 10Mil LLC only, and not with Apple. 10Mil, not Apple, is solely responsible for our games and their content. These terms don't set usage rules that conflict with the Apple Media Services Terms and Conditions.
- Scope of license. Your license to use our games is a non-transferable license to use them on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that our games may also be accessed and used by other accounts associated with the purchaser through Family Sharing or volume purchasing.
- Maintenance and support. We're solely responsible for providing any maintenance and support for our games, as described in these terms or as required by law. Apple has no obligation whatsoever to provide any maintenance or support services for our games.
- Warranty. We're solely responsible for any product warranties, whether express or implied by law, to the extent they aren't effectively disclaimed. If one of our games fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for that game to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever for our games, and any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to any warranty are our sole responsibility.
- Product claims. We, not Apple, are responsible for addressing any claims by you or any third party relating to our games or your possession or use of them, including: (i) product liability claims; (ii) any claim that a game fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar laws.
- Intellectual property. If a third party claims that one of our games, or your possession and use of it, infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement and discharge of that claim.
- Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Developer name and address. Send any questions, complaints or claims about our games to 10Mil LLC, 1209 Mountain Road Pl #12045, Albuquerque, NM 87110, United States, or hello@10mil.club.
- Third-party terms. You must comply with any third-party terms that apply when you use our games, such as your wireless data service agreement.
- Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these terms. Once you accept these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
Ads in our games
Our games are free because they show ads. Some ads are optional: you choose to watch one in exchange for an in-game reward, like a second chance in a round. Others may appear at natural breaks, like between rounds. We can't promise a rewarded ad will always be available.
In-game rewards and items have no cash value. They can't be sold, traded or exchanged for money, and they may change or reset, for example if you delete the game.
Ads are made and provided by other companies. We don't control their content or the products they promote, and we're not responsible for them. If you tap an ad, you may leave our game for a website or app with its own terms and privacy policy. How ad partners use data, and the choices you have, are explained in our privacy policy.
Play fair
When you use our games or this website, please don't:
- cheat, including with hacks, bots, mods or tools that change how a game works, or exploit bugs on purpose (tell us about them instead)
- copy, modify, distribute, sell or rent our games, or make products based on them
- reverse engineer, decompile or disassemble our games, or try to extract their source code, except where the law specifically allows it
- interfere with our games, this website or the ads, including faking ad views or taps, or overloading or attacking our systems
- remove or change any copyright, trademark or other notices
- scrape or copy content from our games or this website in bulk, including to train AI models
- use our games or this website for anything unlawful, harmful or fraudulent, or in a way that violates anyone else's rights
If you break these rules, we may end your license (see Ending these terms).
Our games belong to us
Our games, including their code, art, sound, music, text and design, and this website, are owned by 10Mil LLC or our licensors and are protected by copyright and other laws. "10Mil" and the 10Mil logo are trademarks of 10Mil LLC. Please don't use them without our written permission, except to refer to us and our games fairly and accurately.
Our games may include open-source software or other third-party material under its own license. Those licenses apply to those parts.
Your feedback
We love hearing ideas. If you send us suggestions or feedback, we can use them freely, without paying or crediting you. Please don't send us anything you want to keep confidential.
Updates and changes
We keep improving our games. We may update, change or remove features, content, levels, rewards or ads, and we may stop offering or supporting a game or this website at any time. Some updates may be needed to keep playing, and older devices or iOS versions may stop being supported. When we reasonably can, we'll give notice before a big change, like removing a game. Because our games are free, ending one doesn't entitle you to a refund or compensation, except where the law says otherwise.
Other companies' services
Our games and this website may link to or rely on services from other companies, like Apple, Google and our ad partners. Their own terms and privacy policies apply to those services, and we're not responsible for them.
Disclaimers
Our games and this website are provided "as is" and "as available". To the fullest extent permitted by law, 10Mil disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We don't promise that our games or this website will be uninterrupted, error-free, secure or free of viruses, that every defect will be fixed, or that your progress will always be saved.
Some places don't allow these disclaimers, so some of them may not apply to you. If you're a consumer, you keep any rights the law gives you that can't be waived, such as statutory guarantees where you live.
Limitation of liability
To the fullest extent permitted by law, 10Mil and its owners, employees and contractors aren't liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, game progress or goodwill, arising out of or related to our games, this website or these terms, even if we were told such damages were possible.
To the fullest extent permitted by law, our total liability for all claims arising out of or related to our games, this website or these terms is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, and (b) US$50.
Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that the law doesn't allow us to limit or exclude. If you're a consumer in the EU, the UK or another country whose laws don't allow these limits, they apply only as far as those laws allow.
Indemnity
If you use our games or this website in a way that breaks these terms or the law, and someone brings a claim against 10Mil because of it, you agree to cover our reasonable losses and costs, including reasonable legal fees, to the extent the law allows. This doesn't apply to the extent we caused the claim, or to consumers where the law doesn't allow it.
Governing law and disputes
If something goes wrong, please email us first at hello@10mil.club. Most problems can be sorted out quickly that way.
These terms are governed by the laws of the State of New Mexico, USA, without regard to its conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods doesn't apply. Any legal dispute about our games, this website or these terms will be heard only in the state or federal courts located in Bernalillo County, New Mexico, and you and we agree to the personal jurisdiction of those courts.
If you're a consumer, this doesn't take away the protection of mandatory laws where you live. If you live in the EU, the UK or another country with consumer protection laws like these, you keep the rights those laws give you, and you can bring a claim in the courts where you live.
Ending these terms
You can end these terms at any time by deleting our games and no longer using this website. We may suspend or end your license if you seriously or repeatedly break these terms, if we have to for legal reasons, or if we stop offering a game. When these terms end, your license ends and you must stop using our games. Parts of these terms that by their nature should continue, like ownership, disclaimers, limitation of liability, indemnity and governing law, keep applying.
Changes to these terms
We may update these terms from time to time, for example when we add features or the law changes. We'll post the new version here and update the date at the top. If a change is significant, we'll also give notice in our games or on this site before it takes effect. If you keep playing after a change takes effect, you accept the new terms; if you don't agree, please stop using our games and this website. Changes won't apply to disputes that arose before the change.
The legal bits
- These terms and our privacy policy are the entire agreement between you and us about our games and this website, and they replace any earlier agreements.
- If any part of these terms can't be enforced, it will be enforced as far as possible, and the rest stays in effect.
- If we don't enforce part of these terms right away, we haven't given up the right to do so later.
- You may not transfer your rights under these terms. We may transfer ours, for example if 10Mil is merged or sold, as long as your rights aren't reduced.
- Apart from Apple and its subsidiaries (see App Store terms), no one else has rights under these terms.
- We're not responsible for delays or failures caused by events beyond our reasonable control.
- These terms are written in English. If we provide a translation and it conflicts with the English version, the English version applies, except where the law says otherwise.
